Judicialization and the offer of for zero-to three-year-old children in Rio Grande/RS

The judicialization of slots in Early Childhood Education is the topic of this article. The objective is to understand which conditions have enabled the process of judicialization in Early Childhood Education in the city of Rio Grande/RS, especially regarding the offer of slots for zero - to three-year-olds. From a post-structuralist perspective, with contributions from Foucauldian Studies, this study has taken the concept of government as an analytical tool. The following materials have been analyzed: court injunctions that deal with access to Early Childhood Education in the city of Rio Grande/RS; interview with a family that filed a lawsuit in order to obtain a slot in a day care center; interview with the coordinator of SMEd Enrollment Center; data from the School Census and the Data Management System of SMEd of Rio Grande/RS. The analyses have enabled us to understand that public policies aimed at children are constituted within the political rationality of our time. Therefore, looking at them means assuming that they act as a tool to guide the conduct of children and their families.
